Group wants public to urge him to collect on Indian sales
A 60-second commercial, paid for by the association, hit the local TV airwaves Thursday, asking viewers to e-mail Spitzer and encourage him to collect the taxes.
"Gov. Spitzer pledged on Day One, everything would change," said James Calvin, the convenience store association's president. "But on the tax collection issue, nothing has. Respectfully, our members think six months has been long enough to wait for Day One to arrive."

ReplyDeleteThe above CANNOT HAPPEN, not without a negotiated compact concerning such matters between the New York state government and the affected tribes. Period!!
Why does writerfella know this? Because Oklahoma negotiated compacts with Oklahoma tribes concerning tobacco and gasoline sales, AND THEN BEGAN MODIFYING THE COMPACTS UNILATERALLY WITHOUT TRIBAL INPUT OR CONSULTATION!! Sorry, Mr. Gumby...

Are you thinking of a gaming compact? A state doesn't need a compact before it can (try to) collect taxes on reservation-based sales. It only needs favorable laws and court decisions.
ReplyDeleteStates and tribes can negotiate compacts on almost anything. But they aren't required to have a compact for anything except Class III gaming. The tobacco-products compact between Oklahoma and its tribes was voluntary on both sides, not mandatory.
